1. Preliminary Provisions

1.1. The newsletter service consists in providing subscribed users (hereinafter referred to as: “Users”), via e-mail, to the User’s address provided as part of the registration procedure, with current information about the services offered by Oem24 Sp. z o. o. products and services (hereinafter referred to as: “Newsletter”).

1.2. The service is provided:

1.2.1. using the website www.oem24.pl (hereinafter referred to as: “Website”);

1.2.2. free of charge;

1.2.3. for an indefinite period.

1.3. The Newsletter service is provided by Oem24 Sp. z o. o. with its registered office in Nowa Sól at ul. Inżynierska 8, 67-100 Nowa Sól, entered into the Register of Entrepreneurs of the National Court Register under the number 0000961208, with NIP: 9252136057, REGON: 521503278, phone number (68) 37 78 005, e-mail: info@oem24.pl (hereinafter referred to as the Administrator or OEM24 Sp. z o.o.).

  1. Registration

2.1. Registration for the service is tantamount to acceptance by the User of these regulations and the privacy policy available on the Website (hereinafter referred to as: “Privacy Policy”).

2.2. To register for the Newsletter service, you must:

2.2.1. complete the registration form available on the Website by providing the User’s e-mail address;

2.2.2. accept these Terms and Conditions;

2.2.3. accept the Privacy Policy;

2.2.4. agree to receive the Newsletter to the e-mail address provided by the User as commercial information within the meaning of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219, consolidated text);

2.3. Consents regarding the receipt of the Newsletter are completely voluntary. Failure to give consent will result in the Newsletter service being unable to be provided.

2.4. Registration for the Newsletter service in accordance with the procedure indicated in point 2.2 above results in adding the User’s e-mail address to the e-mailing list. The User’s e-mail address will be used to send Newsletters to the User.

2.5. To use the Newsletter service, the following are required:

2.5.1. possession of appropriate devices: computer, laptop or other multimedia device with Internet access;

2.5.2. access to e-mail.

2.6. The administrator does not provide the devices referred to in point 2.5.1 above, browsers or access to the Internet.

  1. Using the Newsletter service

3.1. The User is obliged to provide true data when registering for the Newsletter service and when using it. The user is obliged to update the data in the event that they change.

3.2. The User undertakes to use the Newsletter service in accordance with the law and the rules set out in these regulations. It is forbidden for the User to provide unlawful content, violating the law or decency.

3.3. The User undertakes not to take any actions that would in any way interfere with the functioning of the Newsletter service, the Website or its elements, and in particular undertakes to refrain from any interference with the content of the Website or its technical elements.

3.4. The administrator is authorized to make any changes to the Newsletter service, as well as to discontinue, permanently or temporarily, the provision of the service without giving a reason.

3.5. The Newsletter is covered by copyright or other rights vested in the Administrator or other persons.

  1. Complaints

4.1. Complaints regarding the Newsletter service may be submitted by the User, for example:

4.1.1. in writing to the Administrator’s address

4.1.2. via e-mail to the following address: info@oem24.pl.

4.2. It is recommended that the complaint contain a description of the complaint, the User’s request and the User’s data. The requirements set out in the previous sentence are in the form of recommendations and do not affect the effectiveness of complaints submitted without the recommended description of the complaint.

4.3. Within 30 days from the date of receipt of the complaint from the User, the Administrator will respond to the complaint and notify the User about the further procedure.

  1. Personal data

5.1. Personal data provided by Users as part of subscribing to and using the Newsletter service are processed by the Administrator.

5.2. Providing personal data by the User is voluntary, however, necessary for the Administrator to provide the Newsletter service. Failure to provide data will result in the Newsletter service being unable to be provided.

5.3. The user has the right to access their personal data and to correct and delete them, in accordance with applicable law.

5.4. Detailed provisions regarding the protection of the User’s personal data can be found in the Privacy Policy.

5.5. Personal data may be transferred to the entity whose services the Administrator uses when sending the Newsletter.

  1. Unsubscribing from the Newsletter

.1. The User may unsubscribe from the Newsletter service at any time and without giving any reason. Such a request should be submitted to the Administrator, e.g. via e-mail to the following address: info@oem24.pl or in writing to the Administrator’s address.

6.2. The Administrator reserves the right to stop providing the Newsletter service at any time. The Administrator will inform the User about the discontinuation of the Newsletter service to the e-mail address provided as part of the procedure of subscribing to the Newsletter.

  1. Amendments to these Regulations

7.1. The administrator reserves the right to change these regulations for an important reason.

7.1.1. the need to adapt the regulations to the law or decisions and judgments of courts or public authorities;

7.1.2. changes in the functionality of the Newsletter service or the Website;

7.1.3. change of data, including names, addresses, identification numbers, included in the regulations;

7.1.4. improve user service.

7.2. The User will be informed about the change in the regulations by sending a notification about the change to the regulations to the User’s e-mail address (with a link to the amended regulations).

7.3. Before the date of entry into force of the amended regulations, the User may declare to the Administrator that he does not accept the amended regulations. A statement of disagreement with the amendment to the regulations is tantamount to resignation by the User from the Newsletter service.

7.4. If the User does not submit the declaration referred to in point 7.3 above or does not resign from the Newsletter service before the amended regulations enter into force, the amended regulations shall be binding on him.

  1. Governing Law and Dispute Resolution

8.1. The law applicable to the contract for the provision of the Newsletter service concluded between the Administrator and the User under the conditions set out in these regulations is Polish law.

8.2. Any disputes related to the conclusion or performance of the contract for the provision of the Newsletter service will be settled by the competent common courts in Poland.

8.3. A user who is a consumer has the option of using an out-of-court method of dealing with complaints and pursuing claims – information on the rules of access to dispute resolution procedures can be found at the following address: http://www.uokik.gov.pl, in the “Amicable resolution of consumer disputes” tab. The consumer also has the right to use the EU ODR online platform for online dispute resolution, available at: http://ec.europa.eu/consumers/odr/.

  1. Final Provisions

9.1. In matters not covered by these regulations, generally applicable provisions of Polish law shall apply, in particular: the Act of April 23, 1964, the Civil Code (Journal of Laws of 2017, item 459, consolidated text), the Act of May 30, 2014 on consumer rights (Journal of Laws of 2017, item 683, consolidated text) and the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219, consolidated text).
